New Delhi [India], August 26 (ANI): Congress MP Manickam Tagore on Wednesday accused the Centre of attempting to delay the implementation of the Supreme Court’s verdict on OBC creamy layer criteria, alleging that the move undermines social justice and affects OBC candidates.
In a post on X, Tagore alleged that the Centre’s move to approach the Supreme Court against the March 11, 2026 verdict in the Union of India vs Rohith Nathan case was an attempt to deny benefits to OBC candidates.

“By moving the Supreme Court to stall the landmark March 11, 2026 verdict (UoI v. Rohith Nathan), the Modi govt is blatantly sabotaging social justice and betraying OBC youth. The Supreme Court clearly ruled: The 1993 OM excludes parental salary from the creamy-layer test; DoPT’s 2004 letter caused illegal, hostile discrimination against wards of PSU/private employees. The Centre was directed to accommodate all eligible candidates by creating supernumerary posts and comply within 6 months. Yet, the Modi govt is seeking a Special Bench to escape implementation and deny rightful allocation to selected candidates!” the MP said.
“Immediately withdraw the review/MA petition and allocate services via supernumerary posts for pending batches as directed by the SC. Strictly adhere to the SC’s 6-month deadline without inventing bureaucratic excuses. Give additional attempts to those OBC candidates who did not apply in OBC prior to judgement in UPSC CSE and all other exams. Give eligible low-income OBC students reservation under the EWS category as well. Upgrade allocations of all affected candidates based on valid OBC-NCL certificates. Overriding valid OBC-NCL certificates issued by State Revenue Authorities is an unconstitutional insult to State powers. Accept them and apologise to the nation’s youth”, he said.
He also urged opposition-ruled state governments to intervene in the matter before the Supreme Court, alleging that the issue concerned the rights of OBC students and federal autonomy.
Earlier on Tuesday, Congress President Mallikarjun Kharge launched a scathing attack on the Prime Minister Narendra Modi-led government, alleging a “conspiracy” to end reservations for SC, ST, OBC, and EWS categories by deliberately keeping government posts vacant and promoting contractual labour.
Taking to X, Congress President Kharge claimed that the BJP’s policy is aimed at snatching away the constitutional rights granted by Dr. B.R. Ambedkar.
“The Modi government has hatched a plan to end reservations through the back door!! In 2015, there were 4.21 lakh vacant posts in the central government. By 2024, this number has risen to 8.24 lakh. In Railways, there are 2.40 lakh vacant posts. In Defence, 2.41 lakh. In the Home Ministry, 1.10 lakh,” Kharge said.
The Congress leader further highlighted the decline of permanent employment in Public Sector Undertakings (PSUs) and the surge in contractual hiring.
“In PSUs, 5.1 lakh permanent jobs have been eliminated. The share of contractual workers has risen from 19% to 49%,” he noted.
“To end reservations, it’s not necessary to amend the Constitution–just eliminating jobs with reservations is enough. This is the agenda of the BJP, which opposes social justice. Keep posts vacant. Sell off PSUs. Increase contracting. And snatch away the constitutional rights of SC, ST, OBC, EWS,” he added.
Kharge added, “The BJP’s policy of conspiring to end the rights granted by Babasaheb’s Constitution has now been exposed.” (ANI)
